By booking a session or purchasing any service or product from Magic Makers Studio or The Magic of Santa®, you agree to the following terms and conditions.

These policies ensure clarity, fairness, and a consistent experience for all clients.

Magic Makers Studio reserves the right to update these terms at any time. Continued use of our services or website constitutes acceptance of any changes.

2. Session Fees and Payments

All session fees, retainers, and product purchases are due at the time of booking unless otherwise stated.

Session fees are non-refundable but may be applied as a studio credit toward a future session at our discretion.

Payments are processed securely through our booking platform. We accept major credit cards and digital payment options displayed at checkout.

3. Cancellations and Rescheduling

We understand that life happens — especially during the holidays. Clients may reschedule their session once with at least 7 days’ notice.

If illness or an emergency arises, we’ll do our best to accommodate your family, even on short notice.

If Magic Makers Studio must reschedule due to illness, weather, or unforeseen circumstances, we’ll work with you to find the next available date.

4. All Sales Are Final

Because all artwork, retouching, and products are custom-created for each client, all sales are final at the time of purchase.

Once a payment is made or an order is placed, no refunds, cancellations, or exchanges will be issued.

This includes all session fees, retainers, wall art, albums, prints, digital files, and other studio products.

Texas law allows for the sale of custom goods and services to be exempt from refund obligations once the creative process has begun.

Our team invests significant time, resources, and artistry into every commissioned session and product.

If a product arrives damaged or defective, please notify us within 7 days of delivery, and a replacement will be provided at no additional cost.

5. Proofing and Client Approvals

Clients are responsible for reviewing and approving all image selections, edits, layouts, and designs prior to production.

Once final approval is given, Magic Makers Studio is not responsible for any errors, omissions, or changes requested after printing begins.

Color and tone may vary slightly between on-screen previews and printed materials due to differences in monitors, devices, and paper types.

All prints and products are produced to professional photographic standards, and minor variations will not be considered defects.

6. Copyright and Image Usage

All images created by Magic Makers Studio are protected under U.S. copyright law.

The studio retains full copyright and ownership of all images.

Clients receive personal-use rights for purchased images and products.

Images may not be altered, sold, or used commercially without written permission.

We reserve the right to use images created in your session for marketing, educational presentations, image competitions, and vendor showcases unless you request in writing before your session that your images remain private.

7. Liability

While we take every precaution to ensure a safe and enjoyable experience, Magic Makers Studio and The Magic of Santa® are not responsible for personal injury, property damage, or loss that occurs before, during, or after your session.

8. Privacy and Data

Your privacy is important to us. Client information collected through our booking system or website is used only for communication and service delivery.

We never sell, trade, or share personal information with third parties.
